TERMS OF USE & CONDITIONS

Estimates - Nova Display, Inc. will provide estimates only at the request of the customer. Such estimates are approximations only and are NOT firm quotations. Nova Display, Inc. shall in no way be required to hold to a price given as an estimate.

Accuracy of Specifications - All quotations are based on the accuracy of the specifications provided. The provider can re-quote a job at time of submission if copy, film, tapes, disks, or other input materials don't conform to the information on which the original quotation was based.

Detailed Information - Nova Display, Inc. makes every effort to communicate with the customer throughout the course of a job. However, if a customer does not give us specific instructions or special requirements, we shall use our best judgment. This is an agreement to accept the finished piece as we produce it. If an order is not satisfactory due to insufficient information, Nova Display, Inc. shall remake the order to the customer's specifications, but it will be treated as a new order.

Creative Work - Artwork, sketches, prints, copies, and all other creative work developed or furnished by the provider are the provider's exclusive property. The provider must give written approval for all use of this work and for any derivation of ideas from it.

Proofs - Proofs are provided by customer request only. If no proof has been requested and the finished piece matches the original file or paper print (hard copy) provided by the customer, Nova Display, Inc. cannot be held responsible for any errors. The provider will submit prepress proofs along with original copy for the customer's review and approval. The provider will not be responsible for undetected production errors if; proofs are not required by the customer.

Color Proofing - Because of differences in ink output, and other conditions between color proofing and computer design preparations, a reasonable variation in color between color proofs and the completed job is to be expected. When variation of this kind occurs, it will be considered acceptable performance.

Payments - We accept Visa, Master Card, in addition to Money Orders, Cashier's Checks and Business Checks. Orders prepaid with a check will be shipped within 24 hours of check clearance. New customers wishing to prepay an order totaling $5,000 or more must allow 7-10 business days for their check to clear. This policy applies to personal, business, cashiers, and certified checks, as well as money orders. All Orders require a 50% Deposit before start of fabrication. Remainder due prior to shipping unless other terms have been determined by Nova Display, Inc. Credit Department. Pricing and specifications are subject to change, without prior notice. Production Schedules - Production schedules will be established and followed by both the customer and the provider. In the event that production schedules are not adhered to by the customer, delivery dates will be subject to renegotiation. There will be no liability or penalty for delays due to state of war, riot, civil disorder, fire, strikes, accidents, action of government or civil authorities, acts of God, or other causes beyond the control of the provider. In such cases, schedules will be extended by an amount of time equal to delay incurred.

Delivery - Charges for delivery of materials and supplies from the customer to the provider, or from the customer's supplier to the provider, are not included in quotations unless specified. Most orders are shipped via UPS or FedEx, unless otherwise specified. For large orders, we'll ship freight collect by the most reliable and inexpensive carrier to your location.

Returns - All sales are final. No refunds are available on orders unless no files have been prepared for printing and no on-line proof has been sent. In the case of a refund on an order that printing has not started, a $15 processing fee will be charged. If an order is cancelled after we have already prepared your files and have shown you an on-line proof an additional $35 fee will be charged. RUSH FEES ARE NOT REFUNDABLE UNDER ANY CIRCUMSTANCES. Should your print job contain manufacturing errors and/or defects, we will rerun and ship the job at no charge. Nova Display, Inc. reserves the exclusive right to judge what a manufacturing error and defect is.
